A Fort Bend County grand jury has indicted a man accused of striking and killing a Cinco Ranch High School football player in a crosswalk last September.

Devin Delvalle was indicted on one count of accident involving pedestrian/ road user in crosswalk, causing serious bodily injury, a state-jail felony.

Delvalle was also indicted on count of manslaughter, a second-degree felony.

District Court Judge Tameika Carter has been assigned to hear the cases.

The felony charge stems from a Sept. 28 accident that occurred around 6:46 a.m. in the 6000 block of Mason Road. Fort Bend County sheriff’s deputies were summoned to the site of the accident and learned that a boy was riding his bicycle in a crosswalk when he was fatally struck by Delvalle’s vehicle.

Deputies said Delvalle remained at the scene and cooperated with investigators. Afterward, Delvalle was booked into the Fort Bend County Jail and charged with motor vehicle collision involving pedestrian or other vulnerable road user within area of crosswalk, a relatively new state law.

“This is a very sad and tragic incident on both sides, for the driver, and especially for the victim’s family,” Fort Bend County Sheriff Eric Fagan told the media in a news release. “Drivers need to slow down and pay attention, and that’s extremely important in areas that are heavily traveled by children.”

A 66-year-old San Antonio man was hit and killed by a vehicle while walking through the intersection of State Highway 36 at Rice Street in October.

Rosenberg Police Chief Jonathan White told The Herald that he will be asking the Fort Bend County District Attorney to upgrade the charges against the accused driver from felony hit and run to murder.

The driver of the Ford Mustang, Gener Castellanos- Moreno, 19, of Rosenberg, was arrested shortly after the accident and charged with failing to stop and render aid involving serious bodily injury, a third-degree felony, Rosenberg police reported.

Castellanos-Moreno fled the scene after the accident, White told The Herald. The accident occurred around 8:09 p.m. Thursday, Oct. 26, on SH 36 between Mons and U.S. 59 was shut down until after 11 p.m. The victim, George Carpenter, was flown by helicopter to a trauma center in the Houston medical center where he later died.
